Contemporary Legal Blueprints Reflected in Sangam Literature

Abstract

This research paper employs a comparative approach to investigate the congruence between contemporary legal statutes and the ethical and social tenets of the Tamil lifestyle described in classical Sangam literature. The Sangam poems reveal that the ancient Tamils prioritized principles of democratic governance and communal consensus from very ancient times. Our classical texts portray the monarch (known as the Vendhar) as the supreme ruler responsible for ensuring the welfare and comprehensive protection of the citizenry. In this structure, service to the people was held in the highest possible regard. Scholars and advisors were appointed to keep the rulers informed of the state of the nation. The Poets (Pulavars) served as essential conduits, communicating the status of the populace, the military strength of neighboring kingdoms, and the prevailing sentiments of the nation to the monarch. Crucially, as reflected in ancient literature, the Pulavars possessed the right not only to eulogize the king but also to openly critique and correct his errors and failures. The objective of this study, supported by substantive evidence, is to demonstrate that just as modern constitutions codify specific citizen rights, the political structure of ancient Tamilakam mandated that the king govern by keenly understanding and fulfilling the fundamental needs of the people. This reveals a sophisticated, ancient system prioritizing the well-being of the populace that mirrors the intent of modern legal blueprints.

இந்த ஆய்வுக்கட்டுரையானது தற்காலச் சட்டங்கள், செவ்வியல் இலக்கியங்களில் குறிப்பிடப்படும் தமிழர் வாழ்வியல் நெறிகளோடு எந்தெந்த வழிகளில் ஒத்து இருக்கிறது என்பது குறித்து ஒப்பியல் நோக்கில் ஆராய்கிறது. தமிழர்கள் பண்டைய காலந்தொட்டே மக்கள் ஆட்சிக்கு முக்கியத்துவம் அளித்து இருந்ததைச் சங்கப் பாடல்கள் வழி அறிய முடியும்.  நமது இலக்கியங்கள் மன்னரை வேந்தராகவும் மக்களுக்கு உரிய பாதுகாப்பை வழங்குபவராகவும் குறிப்பிடுகின்றன.  மக்களுக்கு ஆற்றும் சேவையை உயர்வாகக் கருதினர். மன்னர்களுக்கு நாட்டின் நிலையை உணர்த்த அறிஞர்கள் இருந்தனர். நாட்டு மக்களின் நிலை, அண்டை நாட்டு மன்னர்களின் படைபலம், நாட்டு மக்களின் உணர்வுகள் ஆகியவற்றை மன்னனுக்கு எடுத்துக்காட்டும் கருவியாகவே புலவர்கள் இருந்து வந்தனர்.  பண்டைய இலக்கியங்களில் மன்னரைப் புகழ்ந்து பாட மட்டுமின்றி, அவரது தவறுகளை இடித்துரைக்கும் உரிமையும் புலவர்களுக்கு இருந்தது. நமது நாட்டு அரசியலமைப்புப்படி மக்களுக்கு என்ன உரிமைகள் உள்ளது என வரையறை செய்யப்பட்டுள்ளதோ அதுபோல பண்டைய தமிழகத்தில் மக்களுக்கு என்ன தேவை என்பதை உணர்ந்து மன்னன் அரசாள வேண்டும் என்கிற நிலை இருந்து வந்துள்ளது என்பதை உரிய சான்றுகளோடு வெளிக்கொணர்வதே இந்த ஆய்வின் நோக்கமாகும்.
